Digital Tools of the Supreme Court, namely – Database of Legal Positions 2.0 and Supreme Observer – were Presented in Odesa

On 8 August 2025, an open discussion entitled ‘Commercial Disputes with the State: Legal Proceedings in the Shadow of Leviathan’ took place in Odesa. The Ukrainian Bar Association organised the event within the framework of a grant provided by the EU Project Pravo-Justice. The discussion featured the presentation of the latest digital tools of the Supreme Court – the Database of Legal Positions 2.0 and Supreme Observer. These tools contribute to the consistency of jurisprudence and make legal work more efficient.

“As a European Union project, we support the transformation of Ukraine’s legal sector on its path towards the EU, particularly in commercial jurisdiction. We are developing various tools together with our partners, including the Supreme Court and the Ukrainian Bar Association. These tools aim to ensure the predictability of jurisprudence, particularly in commercial disputes. They will help lawyers obtain relevant and structured information for their daily work,” said Svitlana Maistruk, Key Expert on Court Modernisation at EU Project Pravo-Justice.

Olesia Lukomska, Head of the Analytical and Legal Department of the Cassation Commercial Court in the Analytical and Legal Department of the Supreme Court, highlighted that the number of cases in commercial courts is growing. According to her, in 2024, about 153,000 cases were pending, many of which involved authorities and state-owned enterprises. She also noted that commercial disputes increasingly overlap with criminal proceedings, creating extra challenges for the judicial system.

“Therefore, tools that help streamline practices and decrease uncertainty for litigants are becoming ever more important,” noted Olesia Lukomska.

Yuliia Pozniak, Head of the Sector for Consistency of the Supreme Court’s Jurisprudence at the Analytical and Legal Department of the Supreme Court’s Secretariat, delivered a detailed presentation of the features available in the Database of Legal Positions 2.0 and Supreme Observer. According to her, integrating these tools into the lawyers’ work will not only help draft procedural documents more efficiently, but also give a better understanding of trends in jurisprudence.

“These tools are not designed solely for judges. We want lawyers, academics, prosecutors and students to use them widely, too,” said Yuliia Pozniak, emphasising the vast potential of the new tools.
